Emmitt Taylor appeals his jury convictions for second degree burglary and second degree vehicle prowling following an incident in which he allegedly removed a garage door opener from a truck, used the opener to enter a free-standing residential garage, and was surprised there by the residents. He contends that the States reference to accomplice liability in its closing remarks constituted prejudicial misconduct, because Taylor was not charged under such a theory. Similarly, he contends that the trial court erred in denying his motion to declare a mistrial after the jury, having begun deliberations, sought clarification from the trial court on the issue of accomplice liability. He also contends that the trial court erred in admitting his statement to the owner of the garage that he was not in the garage, but elsewhere smoking crack cocaine. We affirm.
